1. Purpose of This Agreement
Rigs in Paradise 2027 is a community-focused recreational event featuring organized games, beach activities, educational workshops, entertainment, social gatherings, and other group experiences.
This agreement explains the potential risks associated with voluntarily participating in Event activities, the responsibilities of participants, and the proposed release of certain legal claims.
For purposes of this agreement, the "Organizer" means Rigs in Paradise LLC.
References to the "Released Parties" mean Rigs in Paradise LLC, its members, managers, employees, authorized representatives, volunteers, and the three hosting creator teams—WildWanderRV, Determination Unbound, and Free and Easy RV—and their respective participating legal entities, officers, employees, and authorized agents, acting within the scope of Event operations.
Camp Margaritaville RV Resort is a separate venue operator responsible for its own resort operations and designated services. Any release benefiting the resort must be specifically approved and coordinated with the resort and legal counsel.
2. Voluntary Participation
Participation in recreational, educational, and social activities at Rigs in Paradise is voluntary.
Participants may choose which optional activities they wish to attend and may discontinue participation at any time when it is reasonably safe to do so.
Certain activities may require additional instructions, age restrictions, or separate participation agreements.
Participants are responsible for evaluating their own ability to participate safely.
3. Acknowledgment of Activity Risks
Participants understand that Event activities may involve known and unforeseen risks, including injury, illness, property damage, or other harm.
Examples include:
Recreational Games and Competitions
RV Olympics, scavenger hunts, cornhole, team challenges, and similar activities may involve running, walking, lifting, throwing objects, physical exertion, falls, collisions, or contact with equipment and other participants.
Beach and Outdoor Activities
Activities on or near the Texas Gulf Coast may involve uneven terrain, slippery surfaces, sand, weather changes, wind, sun exposure, dehydration, insects, and natural environmental conditions.
Entering ocean water, including during any organized polar plunge if offered, may involve additional hazards such as currents, waves, temperature-related reactions, submerged obstacles, and drowning.
RV Maintenance Seminars
Educational demonstrations may involve electrical equipment, testing instruments, tools, mechanical components, and other RV systems.
Improper use of equipment or failure to follow instructions can result in electrical shock, burns, cuts, physical injury, or property damage.
Creative Workshops
Arts, crafts, baking, decorating, and similar workshops may involve tools, sharp objects, heated surfaces, food ingredients, or other materials presenting ordinary activity-related risks.
General Event Activities
Attendees may encounter crowded areas, uneven walking surfaces, vehicles, equipment, recreational facilities, and other conditions associated with a campground and group event.
Participants acknowledge that not all risks can be anticipated or eliminated.
4. Assumption of Inherent Risks
By voluntarily participating in Event activities, adult participants acknowledge that they understand the ordinary and inherent risks associated with their chosen activities.
Participants agree to exercise reasonable care, follow safety instructions, use equipment appropriately, and avoid activities that exceed their abilities or present an unreasonable personal risk.
Participants are encouraged to ask questions before participating in unfamiliar activities.
5. Release of Liability — Ordinary Negligence
IMPORTANT NOTICE — PROPOSED RELEASE OF LEGAL CLAIMS
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS IMPORTANT LEGAL RIGHTS.
To the fullest extent permitted by applicable Texas law, the undersigned adult participant agrees to release the Released Parties identified in Section 1 from claims for personal injury, illness, death, or property damage arising from participation in organized Event activities, including claims caused in whole or in part by the ordinary negligence of a Released Party, whether arising from an act or omission, negligent supervision, negligent instruction, or negligent operation of an activity.
This proposed release applies only to claims that may lawfully be released in advance under Texas law and only to the extent that a valid, enforceable release is permitted.
Nothing in this agreement is intended to release claims that cannot lawfully be waived, including claims arising from intentional misconduct or any other conduct for which a pre-injury release is prohibited by applicable law.
This section does not automatically release Camp Margaritaville or its personnel from liability arising from their independent operations or services.
6. Participant Responsibilities
Participants agree to:
- Follow reasonable activity instructions and safety rules.
- Use equipment only as instructed or authorized.
- Refrain from dangerous or reckless behavior.
- Avoid participation when impaired or otherwise unable to participate safely.
- Notify activity personnel of observed hazards.
- Respect posted facility restrictions and resort rules.
- Stop participating when continuing would create an unreasonable safety risk.
The Organizer may restrict participation when reasonably necessary for safety.
7. RV Maintenance Demonstrations and Educational Information
Maintenance seminars and demonstrations are provided for general educational purposes.
Information shared during seminars is not a substitute for manufacturer instructions, qualified technical inspections, or professional repair services.
Participants should not attempt unfamiliar electrical, mechanical, or safety-critical work without appropriate knowledge, equipment, and precautions.
Unless expressly designated as a supervised hands-on activity, demonstrations are intended for observation rather than independent participant operation of tools or equipment.
The Organizer does not guarantee that educational information will be suitable for every RV make, model, configuration, or individual circumstance.
8. Food, Beverage, and Alcohol
All organized Event catering and alcoholic beverage service will be handled by Camp Margaritaville and its appropriately authorized personnel or service providers.
Participants should communicate food allergies and relevant dietary accommodation requests through the designated Event process.
Attendees are responsible for complying with legal drinking-age requirements, resort rules, and reasonable safety instructions.
Participants must not engage in activities where their impairment creates a safety risk.
This agreement does not replace the resort's separate legal responsibilities relating to food preparation, beverage service, premises safety, or applicable alcohol laws.
9. Minors and Parental Supervision
Rigs in Paradise welcomes families and children.
Parents and legal guardians remain responsible for supervising minors in their care.
The Event does not provide childcare or continuous individual supervision.
Parents and guardians must ensure that children participate only in appropriate activities and follow applicable safety rules.
Some activities may be restricted based on age, ability, or other safety considerations.
A parent or legal guardian may be required to provide an additional participation acknowledgment for a minor.
Nothing in this agreement should be interpreted as automatically releasing a minor's independent legal claims based solely on a parent or guardian's acceptance.
Any separate release or waiver affecting a minor must be reviewed for compliance with applicable Texas law.
10. Medical Emergencies
Participants understand that recreational activities may involve injuries or medical emergencies.
Event personnel may contact emergency responders when reasonably necessary.
The Organizer does not guarantee the immediate availability of medical personnel, emergency equipment, or medical facilities.
Participants are responsible for their own medical expenses, except to the extent another party is legally responsible.
Participants are encouraged to carry appropriate health insurance and inform companions of relevant emergency contact information.
11. Personal Belongings and Property
Participants are responsible for securing their RVs, vehicles, personal belongings, and equipment.
Participants should exercise reasonable care when using personal equipment or bringing property into activity areas.
The Organizer does not provide personal property or vehicle insurance.
Nothing in this provision excuses the Organizer or another party from liability that cannot lawfully be excluded.
12. Weather and Activity Cancellations
Outdoor activities may be modified, delayed, relocated, or canceled due to weather, environmental conditions, staffing, equipment concerns, or other safety considerations.
The Organizer may suspend activities when continuation would present an unacceptable risk.
Attendees must follow instructions to leave or avoid an activity area when required for safety.
Event cancellation and ticket refunds are governed separately by the Rigs in Paradise Cancellation & Refund Policy.
13. Applicable Law
This agreement is intended to be governed by Texas law, subject to applicable legal requirements and mandatory protections.
If any provision is determined to be invalid or unenforceable, the remaining provisions will apply only to the extent permitted by law.
This agreement does not eliminate rights or remedies that cannot lawfully be waived.
14. Adult Participant Acknowledgment
By separately signing or electronically accepting this agreement, the adult participant acknowledges that:
- They have had an opportunity to read the complete agreement.
- They understand that organized Event activities involve risks.
- Their participation in optional activities is voluntary.
- They understand and accept the ordinary inherent risks described in this agreement.
- They understand that Section 5 contains a proposed release of certain claims, including claims involving ordinary negligence by the identified Released Parties.
- They agree to follow applicable safety instructions and Event rules.
A completed acknowledgment should record the participant's name, agreement version, acceptance date and time, and identifying registration information.
15. Parent or Guardian Acknowledgment
For each registered minor, a parent or legal guardian should confirm that:
- They are authorized to make participation decisions for the minor.
- They understand the general nature of the planned Event activities.
- They accept responsibility for supervising the minor.
- They will follow applicable age and activity restrictions.
- They will provide any additional activity-specific consents that are required.
This acknowledgment does not independently establish an enforceable release of the child's legal claims.
